Allegations. This Settlement Agreement settles Notice of Violation (NOV) CP21- 09-02, which was issued on October 25, 2021. CARB alleged PBB violated the Consumer Products Regulation by selling, supplying, offering for sale, or manufacturing for use in California, Green Gobbler 30% Vinegar Home & Garden, that is subject to and exceeded a VOC limit of 0.5 percent by weight for the General Purpose Cleaner (nonaerosol) category and for failing to display the date of manufacture as outlined in NOV CP21-09-02. CARB alleges that if the allegations described in Paragraph 6 were proven, civil penalties could be imposed against PBB for each and every day the noncompliant product was sold, supplied, offered for sale or manufactured for use in California.
Allegations. 1.2.1 APS&EE alleges that Fiskars sold the Nelson brand of twist nozzles, including 50166, 976-08851, 0-77855-80594-4 (hereinafter collectively the “Products”) in the State of California causing users in California to be exposed to unsafe levels of lead without providingclear and reasonable warningsin violation of Proposition 65. Lead is potentially subject to Proposition 65 warning requirements because it is listed as known to cause cancer and birth defects or other reproductive harm.

Allegations. 1.2.1 APS&EE alleges that Harbor Freight sold Squeegee Item#60398, 37031-192020, 7-92363-60398-0 (hereinafter the “Products”) in the State of California causing users in California to be exposed to unsafe levels of Lead, Di-n-Butyl Phthalate (“DBP”), Di (2-ethylhexyl) Phthalate (“DEHP”), and Diisononyl phthalate (“DINP”) without providingclear and reasonable warnings”, in violation of Proposition 65. The listed chemicals are potentially subject to Proposition 65 warning requirements because Lead is listed by the State of California as known to cause cancer and birth defects or other reproductive harm; DBP is listed by the State of California as known to cause birth defects and other reproductive harm; DEHP is listed as known to cause cancer and reproductive toxicity; and DINP is listed as known to cause cancer.
Allegations. 1.2.1 APS&EE alleges that Raidmax sold the Rhino brand of pliers and screwdrivers, including Rhino pliers AS-47 and Rhino screwdriver AS-51 (hereinafter collectively the “Products”) in the State of California causing users in California to be exposed to unsafe levels of Di (2-ethylhexyl) Phthalate also known as Bis (2-ethylhexyl) Phthalate (“DEHP”) and lead, without providingclear and reasonable warnings”, in violation of Proposition 65. DEHP is potentially subject to Proposition 65 warning requirements because it is listed as known to cause cancer and reproductive toxicity, developmental, male. Allegations. 1. The Drug Price Competition and Patent Term Restoration Act of 1984, commonly known as the Hatch-Waxman Act ("Hatch-Waxman"), created the regulatory mechanism under which the United States Food and Drug Administration can approve generic pharmaceuticals. In 2015, sales of generic pharmaceuticals in the United States were estimated at $74.5 billion dollars. Today, the generic pharmaceutical industry accounts for approximately 88% of all prescriptions written in the United States.
Allegations. 1.2.1 APS&EE alleges that Ferguson sold, or made available for sale in the State of California: (1) Galvanized tee 1” x 1/2" x 3/4" (“Galvanized Tee”), and (2) Lincoln Products Brass Hose Shutoff #102838 (“Hose Shutoff”, and collectively with Galvanized Tee, the “Products”) causing users in California to be exposed to hazardous levels of lead without providingclear and reasonable warnings”, in violation of Proposition 65. Lead is potentially subject to Proposition 65 warning requirements because it is listed under that statute as known to the State of California to cause cancer and birth defects or other reproductive harm.
Allegations. This Settlement Agreement resolves Notice of Violation (NOV) SFES-351, which was issued on June 16, 2020. CARB alleges AAJD Transport, Inc. violated the PSIP Regulation by owning or operating heavy-duty vehicles with gross vehicle weight greater than 6,000 pounds in California and failing to conduct annual smoke opacity inspections, failing to keep adequate records, and failing to provide records to CARB upon request; resulting in eight violations, as outlined in NOV SFES-351. CARB alleges that if the allegations described in paragraphs (1) through (6) were proven, civil penalties could be imposed against AAJD Transport, Inc. for each violation on each and every vehicle.
Allegations. This Settlement Agreement resolves Notice of Violation (NOV) OGV_120419_UCI, which was issued on February 27, 2020. CARB alleges Vincent III AS violated the Low-Sulfur Fuel Regulation by failing to comply with the operational requirements over the course of four days while within Regulated California Waters, as outlined in Notice of Violation OGV_120419_UCI. CARB alleges that if the allegations described in paragraphs 1 through 6 were proven, civil penalties could be imposed against Vincent III AS for each and every vessel involved in the violations and each day.
