Subpoena a. The umpire shall have authority to subpoena witnesses pursuant to Section 2711.06 of the Ohio Revised Code. Upon receiving a request to issue a subpoena(s), the umpire shall contact the other party and hear and consider objections to the issuance of said subpoena(s). The umpire shall not subpoena persons to offer repetitive testimony.
Subpoena. In the event that a subpoena or other legal process commenced by a third party in any way concerning the Deliverables or Services provided pursuant to this Contract is served upon Contractor or the Department, such party agrees to notify the other party in the most expeditious fashion possible following receipt of such subpoena or other legal process. Contractor and the Department further agree to cooperate with the other party in any lawful effort by the such other party to contest the legal validity of such subpoena or other legal process commenced by a third party as may be reasonably required and at the expense of the party to whom the legal process is directed, except as otherwise provided herein in connection with defense obligations by Contractor for the Department.
Subpoena. If INTERTEK is served with a Subpoena, Court Order, or similar document requesting the disclosure of confidential or proprietary information supplied to INTERTEK by the Client, INTERTEK shall promptly notify the Client. In the event that the Client chooses to contest the request, INTERTEK shall cooperate with the Client. The responsibility for contesting the request shall rest solely with the Client. If the Client declines to contest the request or is not successful in contesting the request, INTERTEK will provide the requested information. Any costs incurred by INTERTEK in responding to the request, including reasonable attorney's fees, shall be reimbursed by the Client immediately upon invoicing by INTERTEK.
Subpoena. In the event a receiving party or its agents and subcontractors receives a subpoena or other validly issued administrative or judicial process requesting Confidential Information of the other party, the receiving party shall provide prompt notice to the other of such subpoena or other process. The receiving party, its agents and subcontractors, as the case may be, shall thereafter be entitled to comply with such process to the extent required by law. If a party or its agents and subcontractors is served with a subpoena or other validly issued administrative or judicial process in relationship to the matters contemplated hereby and arising from a proceeding in which the other party is a defendant and the served party, its agents and subcontractors, is not, such other party shall pay all the reasonable out-of-pocket expenses of the served party, its agents and subcontractors, associated with such subpoena or other administrative or judicial process.
Subpoena. Employees must notify their supervisors upon receipt of a subpoena for jury or witness duty, keep their supervisors apprised of the schedule for their jury or witness duties, and report to work when the court schedule permits. On any day an employee is dismissed from serving on a jury or has completed other subpoenaed duty as described in 28.1 during their scheduled work shift, the employee will immediately return to work to complete his or her shift. Should the employee not return to work, leave of absence with pay will not be granted for performance of civil duty. When an employee is subpoenaed as a witness on behalf of the Union, the employee may appear without loss of pay if he or she appears during his or her scheduled work time. Every effort will be made to avoid the presentation of repetitive witnesses. The Union is responsible for paying any travel or per diem expenses for its subpoenaed witnesses, the grievant and the Union representative.
Subpoena. An employee who is subpoenaed to appear in court in a matter regarding an event or transaction which he or she perceived or investigated in the course of his or her District job duties will appear without loss of compensation. The time spent in response to a subpoena will be considered work time. Any payment except travel pay, meals, and lodging received by the employee for such service shall be remitted to the District through the Fire Administration.
Subpoena. In the event that a subpoena or other legal process in any way concerning the Counties’ or any County’s Confidential Information is served upon Contractor, then Contractor agrees to notify the Counties within 24 hours following receipt of such subpoena or other legal process and to cooperate with the Counties or any County in any lawful effort by the Counties or any County to contest the legal validity of such subpoena or other legal process. In the event that a subpoena or other legal process in any way concerning Contractor’s Confidential Information is served upon the Counties or any County, then the Counties or any such County, as applicable, agree to notify Contractor within 24 hours following receipt of such subpoena or other legal process and to cooperate with Contractor in any lawful effort by Contractor to contest the legal validity of such subpoena or other legal process.
