In the event that Facebook migrates from Audible Magic blocking to its Rights Manager system in any country outside of the Territory without a valid license, Publisher shall not be bound by the above covenant not to sue in any such territory. Nothing in this paragraph is intended to be a permanent waiver of any of Publisher’s rights or remedies in an unlicensed territory.
