The Individual. Is a member of a Federally recognized Indian tribe; • Resides in an urban center and meets one or more of the four criteria: o Is a member of a tribe, band, or other organized group of Indians, including those tribes, bands, or groups terminated since 1940 and those recognized now or in the future by the State in which they reside, or who is a descendant, in the first or second degree, of any such member; o Is an Eskimo or Aleut or other Alaska Native; o Is considered by the Secretary of the Interior to be an Indian for any purpose; or o Is determined to be an Indian under regulations issued by the Secretary; • Is considered by the Secretary of the Interior to be an Indian for any purpose; or • Is considered by the Secretary of Health and Human Services to be an Indian for purposes of eligibility for Indian health care services, including as a California Indian, Eskimo, Aleut, or other Alaska Native. Indian Health Care Provider (IHCP): Pursuant to 42 CFR § 438.14(a), a health care program operated by the Indian Health Service (IHS) or by an Indian Tribe, Tribal Organization, or Urban Indian Organization (otherwise known as an I/T/U) as those terms are defined in section 4 of the Indian Health Care Improvement Act ( 25 U.S.C. 1603). Individually Identifiable Health Information (IIHI): Patient demographic information, claims data, insurance information, diagnosis information, and any other information that relates to the past, present, or future physical or mental health or condition, provision of health care, payment for health care and that identifies the individual (or that could reasonably be expected to identify the individual). Information: Any “health information” provided and/or made available by the Department to a Trading Partner, and has the same meaning as the term “health information” as defined by 45 CFR Part 160.103. Information Gathering and Assessment (for Medicaid SSI members only): A detailed evaluation where the care management staff collects all relevant information about the member’s health care, and cultural and socioeconomic needs to conduct needs- stratification and to develop the Comprehensive Care Plan. The Individual. Employer may not circumvent the provisions of this Section by utilizing Section 05.00.00, APPLICATION TO SUBCONTRACTORS, to subcontract to operators of individually-owned and manned pieces of equipment. Other New Individual Accounts With respect to New Individual Accounts not described in paragraph A of this section, upon account opening, the Reporting United Kingdom Financial Institution must obtain a self-certification which may be part of the account opening documentation, that allows the Reporting United Kingdom Financial Institution to determine whether the account holder is resident in the United States for tax purposes (for this purpose, a U.S. citizen is considered to be resident in the United States for tax purposes, even if the account holder is also a tax resident of another country) and confirm the reasonableness of such self-certification based on the information obtained by the Reporting United Kingdom Financial Institution in connection with the opening of the account, including any documentation collected pursuant to AML/KYC Procedures.
No Individual Liability No Board member, officer, agent, director, or employee of the Authority shall be charged personally or held contractually liable by or to any other person under the terms or provisions of this Agreement or because of any breach thereof.
No Individual Authority Except as otherwise expressly provided in this Agreement, no Member, acting alone, shall have any authority to act for, undertake or assume any obligations or responsibility on behalf of any other Member or the Company.
Employees and Compensation The Company shall not do, or agree to do, any of the following acts: (a) make any change in compensation payable or to become payable by it to any officer, employee, or representative; (b) make any change in benefits payable to any officer, employee, or representative under any bonus or other contract or commitment; or (c) modify any collective bargaining agreement to which it is a party or by which it may be bound.
Employees and Contractors The number of employees or contractors used by Operator in conducting operations hereunder, their selection, and the hours of labor and the compensation for services performed shall be determined by Operator, and all such employees or contractors shall be the employees or contractors of Operator.
No Rights to Employment The Participant acknowledges and agrees that the vesting of the RSUs pursuant to Section 2 hereof is earned only by continuing service as an employee at the will of the Company (not through the act of being hired or purchasing shares hereunder). The Participant further acknowledges and agrees that the transactions contemplated hereunder and the vesting schedule set forth herein do not constitute an express or implied promise of continued engagement as an employee or consultant for the vesting period, for any period, or at all.
EMPLOYEES AND SUBCONTRACTORS It is understood that, from time to time, it may become necessary for the Contractor to replace an individual working as an employee or subcontractor of the Contractor. All such removals or replacements shall be subject to Owner’s prior approval. Owner reserves the right to approve a replacement, which approval shall not be unreasonably withheld, or terminate the Work, either partially or in its entirety without further obligation to the Contractor thereunder other than to remit payment for the Work rendered up to the termination date. Contractor agrees that Owner may, at any time, with cause, require Contractor to remove an individual from the performance of the Work. An election by Owner of any of its rights under this Section 19 shall not affect the Contractor’s responsibilities, liabilities or warranties under this Agreement.
No Rights to Continued Employment Neither this Letter Agreement nor any of the rights or benefits evidenced hereby shall confer upon you any right to continuance of employment by the Company or interfere in any way with the right of the Company to terminate your employment, subject to the provisions of Section 4 above, for any reason, with or without Cause.
